D4D Real Estate Development, LLC v City of North Bend.  The developer* filed a LUPA case against the City in King County Superior Court, challenging the City’s decision regarding a sewer lift station offered by the developer to serve the new proposed plat.  The court granted the City’s motion to dismiss at the Initial Hearing, where we successfully argued that the developer had failed to properly serve the City with the LUPA petition.
